Minor Host's User Terms Of Service Policies:

Domain Registration: Minor Host provides no assurance that the requested domain name can be registered for users. Registration confirmation is required before assuming the registration of requested domain names. The registration and use of domain names are subject to the terms of the relevant naming authorities (ICANN for .COM/NET/ORG, and Nominet for .UK). Users must be aware of and comply with these terms, with no right to claim against Minor Host for domain name refusal. Administration charges are non-refundable, even in cases of refusal by the naming authority.

Liability and Disputes: Minor Host holds no liability for users’ domain name usage and disclaims responsibility for disputes between users and others. In case of disputes, Minor Host may, at its discretion, withhold, suspend, or cancel domain names. It may also make representations to the relevant naming authority without being obliged to participate in the dispute.

Billing and Services: Full payment is required before releasing any domain to another provider. Service charges are outlined on Minor Host’s website and are due in advance. Failure to pay by the due date allows Minor Host to suspend services. Users must indemnify Minor Host against breaches and third-party claims arising from service provision.

Termination and Breach: Non-payment may lead to service suspension or agreement termination without notice. Failure to correct a breach within seven (7) days of notice may result in immediate agreement termination. In cases of user insolvency, Minor Host reserves the right to terminate the agreement.

Data Handling on Termination: Upon termination, Minor Host may immediately block users’ websites, remove all data, and, at its discretion, hold data for a period determined by Minor Host. Data retrieval is possible at the user’s expense, subject to payment of outstanding amounts.

Affiliate Policies: Affiliates must not manipulate affiliate links and adhere to the rules of displaying sites. Spamming or advertising in violation of site rules will result in reported links.

Refund and SLA Conditions: Users dissatisfied with services can contact support for rectification; if unresolved, a refund is available within 15 days. No refunds apply past the 15-day period, including for specific services such as domains, SSL certificates, VPS, or dedicated servers. SLA conditions apply, with downtime below 99.9% credited with one free month.

Free Domain and Service Delivery: Free domains are provided with premium hosting packages on yearly payments. Only one free domain is registered per account. Delivery of services is immediate upon successful payment, with automated receipts sent to customers.

General Web Hosting Policies: Users agree to the Terms and Policies as an integral part of their relationship with Minor Host when using their accounts. Compliance with these policies is essential for maintaining a positive hosting relationship with Minor Host.

Minor Host’s General Terms and Policies

The provision of services by Minor Host, referred to as “Minor Host,” is exclusively for authorized individuals or organizations, denoted as “Subscribers” or “you.” Your utilization of the service is contingent upon the constraints outlined below. By engaging with the service, you explicitly agree to abide by all these Terms and Policies. Failure to comply necessitates the immediate cancellation of your account, and any subsequent use or attempted use of the service is prohibited.

Scope:

• For individual Subscribers, these Terms and Policies are applicable to all individuals accessing the service through your account.
• For commercial Subscribers, these Terms and Policies extend to all employees, agents, and customers. Violations by anyone using your account are considered violations by you.

Prices and Charges: Minor Host offers the use of cPanel and domain control panels at no cost. However, any charges incurred due to misuse or abuse by you may be passed on to your account.

Term: While the service is available for as long as you wish to use it, Minor Host reserves the right to terminate the service if your usage violates the terms of use.

Backups: Minor Host conducts daily backups, but their guarantee is not absolute. Clients are advised to personally back up their data. Restoration of backups incurs a one-time $10 fee.

Grounds for Suspension and Termination: You agree to comply with these Terms and Policies, and any violation may result in suspension or termination by Minor Host. Such violations include, but are not limited to:

• Violation of applicable laws and regulations.
• Hosting explicit adult content as the primary focus.
• Misuse for file or image hosting.
• Attempts to break or compromise security.
• Engagement in spamming, resulting in blacklisting.
• Use for unauthorized relays or denial-of-service attacks.
• Hosting phishing content.
• Providing false information during sign-up.
• No bill credit during suspension, and termination may involve retaining paid amounts as liquidated damages.

Security: You agree not to access private areas of the service and promptly notify Minor Host of any unauthorized use or security breaches.

Intellectual Property: Minor Host does not scrutinize all materials on the service but will respond to copyright infringement complaints sent to abuse@minorhost.com. Users are responsible for their posted content, and Minor Host is indemnified against related claims.

Liability and Warranty: Your use of the service is at your own risk, and except for explicitly provided information, products, or services, Minor Host is not liable for third-party materials’ accuracy. No financial liability is assumed by Minor Host, and warranties, whether express or implied, are disclaimed.

Resource Usage: Users must adhere to resource usage policies, such as:

• Using system resources below 10% for over 60 seconds.
• Avoiding unattended server-side processes and IRC-related software.
• Prohibiting file-sharing and peer-to-peer activities.
• Creating backups stored for a maximum of 7 days.

Minor Host operates the service on an “as-is, as-available” basis, without guarantees of error-free or uninterrupted service. Users are encouraged to download backups locally and manage system resources responsibly.

VPS CPU Usage Policy

Clients are required to refrain from running processes on their VPS that generate a CPU load exceeding 0.9 on the VPS for an extended period or causes high CPU load on the host node. Essentially, clients commit to avoiding the equivalent of utilizing a full core for an extended duration. Disruptive CPU usage may lead to VPS reboot, shutdown, and/or suspension, irrespective of the time elapsed.

Content Disclaimer: You acknowledge and accept that the Service may offer information and access containing controversial, sexually explicit, or potentially offensive material. Minor Host holds no responsibility for or control over such content. Users are solely responsible for utilizing screening software or other methods to restrict access, especially concerning minors, to objectionable material.

Dispute Resolution: Any dispute arising between you and Minor Host related to your use of the Service, not resolved amicably, shall be subject to binding arbitration under the auspices of Bangladeshi law and International Law.

Governing Law: These Terms and Policies are governed by Bangladeshi laws and International Laws in all respects.

Cancellation Procedure: Requests for cancellation must be submitted through the client area by clicking the icon next to the desired package and selecting ‘Request Cancellation.’ Immediate cancellation means termination within 24 hours. Clients must ensure the cancellation of PayPal subscriptions.

Resellers: Resellers can use their website for personal or client sales but cannot host free accounts. Transfers are only free for cPanel to cPanel transfers. Manual transfers incur a $10 one-time charge. Resellers can transfer up to 30 accounts free, with additional accounts charged at $1 each.

Prohibited Content: Certain content is strictly prohibited, including child pornography, adult content, copyrighted material not owned by you, file hosting or download sites, hacking community websites, botnet controllers, scamming or fake websites, and discount voucher abuse.

Account Payments and Over usage: For Shared/Reseller accounts, actions are taken after specific days of overdue invoices. VPS and Dedicated servers also face suspension and termination based on overdue invoices. Over usage fees for disk space and bandwidth are applicable.

Amendments: Minor Host reserves the right to amend these Terms and Policies at any time. Amendments will be posted in the terms of use section of the Service, and continued use implies consent. If you disagree with the amendments, you may terminate your use of the Service by notifying Minor Host.
